Liabilities & Responsibilities

Due to the endless variety of sail cloth materials in fibres, laminates and membranes, as due to the endless number of awning materials, as due to the limited available information and knowledge on their technical make, as well as due to the goods actual quality and state of maintenance we are forced to define and formulate some liability exclusions. Even though the exclusions most probably will hardly come to rule, in theorie they could become a case. Please take a look at below statistik about reclamations since the RED GULL OY foundation in 2008 (Standing 24.08.2011).

 

Please note, read and take knowledge that all orders accepted, from 24.08.2011 on, by our partners and us (RED GULL OY) are accepted from our side, subject to the below written:

 

Even though we do all effort and apply all possible prudence and accuracy we cannot guarantee that with

 

 - Sails made of Dacron

  • sail numbers, logos or tell tales will not go loose
  • imprints will not dissolve or go loose
  • mildew and moulds will be fully eliminated and not come back
  • stressed, aged and damaged seams or UV-protections will come loose during process or at an later moment
  • stressed, aged and damaged zips will come loose or take any kind of damage by the cleaning or regeneration process
  • windows will go dim, cloudy or ditchy
  • all pollutions can be removed

 

- Sails made of laminates and membranes

  • sail numbers, logos or tell tales will not go loose
  • imprints will not dissolve or go loose
  • mildew and moulds will be fully eliminated and not come back
  • mildew and moulds in the inner of a laminate or membrane sail will spread out, be activated or occur during transport, during treatment or at any later moment
  • laminate glues will show discolouration due to mildew infects, after removal of the mildew or the after the sails cleaning or regeneration
  • delaminations take place on used laminates during the cleaning or regneration process, age irrelevant
  • delaminations take place at the removal of bigger mildew spots
  • at aged laminate sails and membrane sails, that the bonding strength is still strong enough to prevent delamination from the cleaning- or regeneration process
  • windows will go dim, cloudy or ditchy
  • all pollutions can be removed
(Note: Within the RED GULL PRO2-Regeneration or PRO-2 Cleaning processes, the inner of a laminate cannot be reached!)

 

- Sails undergoing the RED GULL PRO-2 Regeneration process

  • to what amount the profile will be regenerated
  • how long the treatment will last (this relates primarily to the handling, the care and the use the sail receives after treatment)
  • in what amount the haptics improve
  • some of the Dacrons or laminate sails may not take on the RED GULL PRO-2 Regeneration process (e.g. strongly or in the past siliconised sails)
(Note: Such fibre properties or siliconisations leading to a none or only partly functionality of the Sail Regeneration, cannot be be detected in advance within our technical possibilities)

 

 - Awnings, spray hoods and other covers

  • mildew and mould will be fully eliminated and not come back
  • no discolourations or staining takes place, in special on the textile inner side
  • colour instable fabrics or PVC/PU materials loose colour or change colour
  • colours appear for 100% as in new condition
  • discolourations due to bird and sea gull dropping will revitalize
  • windows will not goe dim, cloudy or ditchy
  • that are in use, zips are still strong enough for passing the RED GULL cleaning and proofing process without damages
  • older and damaged awnings will still go proof
  • that are in use the fabric structure is still strong enough for passing the RED GULL cleaning and proofing process without damages
  • all pollutions and moulds can be removed

 

- Leather applications on sails, anwnings, spray hoods and other covers

  • will not go clean again
  • will not discolour or stain
  • will bleed into surrounding fabrics
  • become brittle

 

- Fabrics with sensible materials, e.g. Mylar, special films or other sensible textile or constructive parts

  • damagings occur, since these materials have not been appointed
  • damagings occur, since no sperate or special treatment had been ordered

RED GULL is forced to reject all responsibilities related to

  • existing defects present in delivered contract goods
  • hidden deficits on delivered contract goods, not recognizable by simple view
  • at not recognizable material weaknesses and invisible fabrics structural weaknesses on contract goods
  • evt. damages from previous treatments, processes or handlings, or damages in consequence of previous treatments, processes or handlings
  • for reclamations on treated goods, that have been taken in use meanwhile
  • reclamations given later than 10 days after receipt of goods
  • reclamations in relation of not fullfilled finacial customer duties: unpayed invoices. Open or unpayed RED GULL invoices, free us from all responsibilities towards the belated customer
The maximum refunding value for damages unanimously occured by a RED GULL treatment and accepted as such by RED GULL OY, is the treatments value.

We only take oders subject to above. Any person or any company supplying goods for treatment at  RED GULL Oy partners or at RED GULL Oy, accepts to have read and understood above terms and exclusions.
